    According to Wisconsin state statute, a recall election can only be triggered if the number of names on a recall petition is equal to 25 percent or more of the number of district residents who voted for president in the last election.

    Last time I looked into this the number was around 3,000 signatures here in the Hudson district – I could be way off with these numbers, so please do not quote me on it.
    .
    Notwithstanding, it is amazing when you consider that the total votes cast in the last school board race was roughly 6,000 (again, this is a guess on my part).

    OVERVIEW OF RECALL PROCESS

    I. Register the Recall Committee with the school district clerk
    A. File Campaign Registration Statement
    B. File Statement of Intent to Circulate Recall Petition

    II. Circulation of Petition
    A. Circulation begins the day of filing and must be completed within 30 days
    B. Number of signatures required
    1. must be determined by the school district clerk,
    2. is equal to 25% of the vote cast for the office of President of the United States at the last presidential election held within the district.

    III. Campaign Finance Report
    A. Must be filed no later than 30 days from the registration date or within 5 days after the recall petition is filed.
    B. The filing officer must send notice to the recall committee of the filing deadlines and reporting periods.

    III. Review of the Petition by the Filing Officer
    A. Filing officer has between 10 and 31 days to determine the sufficiency of the petition. The filing officer will review and verify that the petition follows the statutory requirements and the signatures are valid.
    B. Challenges- In addition to the filing clerkís review of the petition, the officeholder may bring specific challenges to the petition.
    1. Within 10 days after the petition is filed, the officeholder (school board member) can challenge the petitionís sufficiency.
    2. Within 5 days of the challenge, the petitioner (ccfpc) may file a written rebuttal to the challenge.
    3. Within 2 days of the rebuttal, the officeholder may file a reply to any new matter raised in the rebuttal.
    4. Within 14 days, the filing officer makes a determination as to whether the petition is sufficient or insufficient.

    IV. Filing a Certificate of Sufficiency/Insufficiency
    A. If the petition is found to be sufficient
    1. The filing officer shall immediately transmit the Certificate of Sufficiency to the school board and the petitioner (ccfpc).
    2. The school board must set a date for a recall election.
    B. If the petition is found to be insufficient
    1. The filing officer shall immediately transmit the Certificate of Insufficiency to the school board and the petitioner (ccfpc).
    2. Petitioner (ccfpc) may amend the petition within 5 days of the certification, to correct certain insufficiencies.
    3. Within 2 days after the amended petition is filed, the filing officer must review the amended petition and issue an amended Certificate of Sufficiency/Insufficiency.
    C. Within 10 days of the filing of the Certificate of Sufficiency/Insufficiency, the petitioner (ccfpc) or the officeholder (school board member) may appeal the decision to the State Elections Board, if it alleges:
    1. the issuance of the certificate is contrary to law, or
    2. the filing officer abused his or her discretion when determining the sufficiency or insufficiency.

    V. Recall Election
    A. If a petition is certified sufficient, the school board must set a date for an election on the Tuesday of the 6th week after the Certificate of Sufficiency was issued.
    1. If there is only one candidate to run against each board member, this election will be the recall election.
    2. If there are multiple candidates running against the existing board members
    A. this election will be a recall primary,
    B. the recall election will be held on the Tuesday of the 4th week after the recall primary.
    B. The officeholder (board members) against whom the recall petition is filed is an automatic candidate at the recall election. Any other candidate must file the necessary forms to be placed on the ballot.
