Unjust Law or the Coming of the Green Police

MANHATTAN (CN) – An elderly activist has the right to pass out literature outside courthouses urging jurors to reach verdicts based on their consciences, even if the findings contradict the letter of the law, a federal judge ruled.
The thing I love about this is in the article they say, “The concept of nullification allows jurors to acquit criminal defendants who are technically guilty if they believe the person does not deserve to be punished.”
So something as ubiquitous as speeding, jaywalking, pot possession, or any myriad of fines the MAN wants to impose on you can be ruled in favor of a defendant by a simple majority of a jury thinking a law is stupid.
Can you see an attorney, or defense attorney, telling the jurors that they also have the right to determine whether the law itself is just? I think any long reaching list of offenses the “Law” says you did simply to make an example, or raise revenue, falls into this category. If someone is caught speeding 8 miles over the limit and it ticketed, why is it that the other 99.9% of the people speeding over that same stretch of highway that day don’t get a ticket?
Something to think about when the GREEN Police come knocking on your door to investigate how you re-cycle.
George H. Smith on the Moral Basis for Resistance and Revolution
Posted by: | CommentsA hum dinger for all my libertarian friends out there.. In this compelling talk, George H. Smith outlines the history of resistance and revolution. You’ll hear GH Smith wax regarding Locke, Smith, Jefferson, and more. Smith discusses, for example, Adam Smith’s test for the initiation of physical force against ones government: “when abuse of power becomes gross, flagrant, and palpable then armed resistance is allowable.” An example of what would constitute a gross, flagrant, and palpable abuse of power was “a tax that absorbs one-third of the people’s wealth . . . any government that would impose such a burdensome tax as one-third has obviously crossed the line into tyranny and may be forcibly overthrown.” And the reason for this 1/3 test, as discussed by GH Smith, was that the lowly feudal serf was required to turn over one-third of his produce to his overlord. This means that any citizen who is required to turn over more than one-third is actually WORSE OFF than the lowly medieval serf!

Nation Needs Shared Liberty, Not Sacrifice

President Obama calls for “shared sacrifice” to address the nation’s debt. But forcing individuals to sacrifice their present and future wealth to politicians’ whims caused the problem. To restore economic prosperity, we need to stop sharing sacrifices and start sharing a respect for liberty and people’s rights.
Get The Hell Off Your Property
Posted by: | CommentsAs the over-hyped Category 1 Hurricane Irene targeted the east coast of the United States, the customary mandatory evacuations were issued by several governors and even the mayor of New York City. Mayor Bloomberg warned that staying behind was against the law. He later echoed concern for the safety of first responders coming to the aid of those that elected to stay in their homes.
The real question is under what principle of freedom does government have the power to order people off their private property when the same government declares a weather or any other circumstance to be dangerous. Furthermore, when an evacuation occurs who is in charge of protecting my property from thieves taking advantage of the situation? The same police that Mayor Bloomberg says should not be put in harm’s way by people that stay on their property.
If the government can order you off your property for a storm, then the idea of freedom in this country is just blowing in the wind.

He (Pope Benedict XVI) also answered a question from a seven-year-old Japanese girl who was caught up in the tsunami about why so many children had to suffer in natural calamities.
“I ask myself the same question,” he said. “We don’t have the answers, but we know that Jesus suffered as innocent children suffer.”
Holy Crap! The children in Japan suffered for a very specific reason, there was a god damn tsunami coupled with an earthquake! Life is dangersous living near the ocean where there is a probability of both events occurring near a nuclear reactor complex.
To suggest that the suffering of these kids in Japan has ANYTHING to do with the evil religious mysticism (which is clearly implying the inane notion here of original sin) vomited by this so-called pope is beyond what ought to be the norms of a civilized society.
This cat makes me vomit in my throat.
S&P’s Rating Warning: A “Catch-22″..
Posted by: | CommentsIf S&P has taken this long to issue a negative watch on The US Treasury’s ability to repay debt, what would it actually take for this rating agency to make good on its warning? This is the question no one wants to really discuss in the media. It’s as if people here in the U.S. actually think that folks all around the world don’t already see our situation for what it really is… and think they can keep it that way. Moreover, If the United States has gotten away with a AAA rating all the while incurring massive deficits, doing basically nothing to address the incredible imbalances in the government, one has to really wonder… Well, now that the S&P has finally come out of the closet on this let’s briefly explore further.
It’s pretty clear now what will happen, and we will see a package of three measures; two of which are totally and completely antithetical to everything the Tea Party supposedly ran upon (not to mention what the Republican Party ought to stand for). We already know that Paul Ryan stipulated an increase in the debt ceiling – he has no fundamental aversion to big government, notwithstanding his occasional rhetoric and appearances as a deficit hawk. If he did, he would not have already agreed to engage in the illegal/legal ceiling charade (not to mention his support for the bailouts). So, you have Ryan’s “extreme” plan on the one hand, and the Obama plan (hitting the snake oil train today) on the other with both plans not-so-tacitly assuming an increase in the debt ceiling. Only people that serve no purpose in life can continue to come up with stupid ideas. The Illinois AG did just that. Her latest stupid idea is to publish “all” registered gun owners. Well that’s just dandy, except for one thing. Now the criminals will know who exactly DOES NOT own a gun. That is just positively brilliant!
In addition, who put the AG in charge of such a ludicrous idea? I, for one, did not know that is in their job title. How about you? To see more of this silliness, :
Death by Administration

By now most people know about the extraordinary raises that the government school district administrators received. No matter how much spinning Ms. Sweet wants to do, she can’t explain to the average taxpayer why on earth these people are getting filthy rich.
Nancy Sweet, the “District Deputy Director/HR Director” is nothing more than a glorified secretary. She has no discernable skills that would allow her to come even close to earning $175,000 a year. That’s right folks- $175,00 a year! It’s 123,000 in salary and another $52,000 in benefits!</a>
Ms. Sweet can go suck an egg. She is the poster child for what is wrong with government education. She says that the district can’t hire and retain qualified candidates because the salaries are too low! What a crock of shit. How about a 20% pay CUT Nancy? Then you can find out what’s happening in the REAL WORLD, not your little communist utopia.

Any insurance involves the pooling of individual risks. Under this arrangement, there are winners and losers. Some of the insured will receive more than they paid in premiums and some will pay more into the system than they ever get back. This is a form of income redistribution from the healthy to the sick, but the characteristic mark of insurance is that no one knows in advance who the winners and losers will be. They are distributed randomly or unpredictably, and the resulting income redistribution within a pool of insured people is unsystematic.
If this were not the case — if it were possible to predict the net winners and losers — the insurance losers would not want to pool their risk with the insurance winners; they would seek to pool their risk with other “losers” at lower premiums.
