OPPOSE SOPA – PIPA

internetstrike e1326908022990 OPPOSE SOPA   PIPAIf you supported (or attended) the protests in Madison over collective bargaining, you were exercising your freedom of speech. If you protested the protestors in Madison, you too were exercising your freedom of speech. Freedom of speech is, in fact, what I would consider an inviolable, sacrosanct, principle of American-style democracy and fully reflects the brilliant enlightenment ideology of our founders and the founding documents they penned. It doesn’t mean you are endowed with some un-sourced, uncaused, supernaturally or socially granted right to say what you want, wherever, and whenever. Freedom of speech is fundamentally premised upon the recognition and due respect for the property upon which one speaks – it is a reflection and outgrowth of the fundamental of individual rights.

When you have permission from those who have ownership of said property to speak, you are enjoying the freedom of speech, properly understood. If you do not have their permission, and speak anyway, you are wrongfully trespassing and violating their pre-emptive right to hold and enjoy property privately. This means the land upon which you are holding your sign, or speaking into your megaphone; the building in which you rise to deliver your message; the radio station or television studio in which you are crafting your words and images; or, indeed, the very web page upon which you are posting your thoughts (video, writing, audio message). Since we the people have granted to government the unique use of physical force in our society, they have a profound role to uphold the individual rights of property owners who invite-or give permission to-people to speak. We have the right to speak our minds provided we do not violate the actual rights of others in the process – my individual rights end where yours begin. Were you or I invited onto private property to speak and demonstrate, and the police (or anyone) used force to unilaterally silence such speech THAT would be a violation of your freedom to speak and the property rights of the landowner. Alternatively, if you run into a lecture hall where an invited speaker is presenting views you are opposed to, and begin to shout, interrupting the speaker, it is YOU who are violating the speaker’s (and the venue owner’s) freedom of speech – you are NOT legitimately exercising your own freedom, but rather preventing someone else from it.

If you were one of the impassioned protestors in Madison who showed up on the steps of the capital, on either side of the debate, you were exercising this protected right and the principles behind it. You were not hauled off to jail as a consequence of protesting against Governor Walker because the land upon which you demonstrated is owned, theoretically, by no one in particular, and everyone simultaneously, i.e. public property. If we lived in a dictatorship, Governor Walker could have simply ordered the Capital Police to seize your signs, and toss you in jail. Protesting on public lands is, in fact, a unique case in an otherwise general freedom of speech. It is the government’s agents responsibility to ensure that your right to speak is protected, and not violated – whether it be on public lands (while abiding the reasonable access rules needed), or, especially, on private property. The worst case of all is where the government presumes ownership of all property and simply uses its unique access to physical force to censor you from speaking out merely because the message you want to deliver is either antagonistic to, or otherwise inconsistent with, official government policy. Tied for first worst, you are hauled off, or censored, because someone standing next to you, who you don’t know or perhaps don’t even agree with, held up a sign or played some audio that the government didn’t appreciate, or violated someone’s intellectual property rights, and therefore you were summarily denied the right to speak (or even remain on the premises because the government could condemn the property forthwith) by use of the force of government – all without any due process. That is what happens in a dictatorship, or any overtly tyrannical, or theocratic/religious, state.

Which brings me to SOPA (and PIPA) –ill-conceived legislation supported by the Motion Pictures Association of America (MPAA), and others who claim (correctly) that piracy of protected material is a problem on the internet. The stated intention of this expansion of the Federal Government’s power over the internet is ostensibly to protect intellectual property, such as music, video content, and literature. While protecting the individual rights of intellectual property owners IS a legitimate function of government, it cannot be the case that such protection simultaneously tramples the rights of other’s free speech in the process. But that is exactly what this legislation would do. The legislation’s fundamental premise is that the internet is actually the property of the United States Government, and as such those who happen to be in power today can unilaterally use force to restrict your and my ability to exercise our freedom of speech, properly understood. The proponents of SOPA view the internet as being owned by the United States Government, and therefore subject not just to protection of intellectual property, but to the overt use of force to shut down entire websites and internet communities without the application of the rule of law. This is wrong, it is a violation of property rights, and in fact a violation of the individual rights of website owners and other content producers.

As stated on Wikipedia’s site “The originally proposed bill would allow the U.S. Department of Justice, as well as copyright holders, to seek court orders against websites accused of enabling or facilitating copyright infringement. Depending on who makes the request, the court order could include barring online advertising networks and payment facilitators from doing business with the allegedly infringing website, barring search engines from linking to such sites, and requiring Internet service providers to block access to such sites. The bill would make unauthorized streaming of copyrighted content a crime, with a maximum penalty of five years in prison for ten such infringements within six months. The bill also gives immunity to Internet services that voluntarily take action against websites dedicated to infringement, while making liable for damages any copyright holder who knowingly misrepresents that a website is dedicated to infringement.[4]”

This is analogous to all the protestors against Governor Walker who were on the grounds of the capital in Madison being hauled off, en-masse, because a single protestor on the other side of the block held up a sign that violated the copyright of some third party. If you or I violate a copyright in our activity on the internet, if someone pirates intellectual property, that is a problem and piracy laws are already in force. But trampling the rights of otherwise innocent website owners and their law abiding site visitors is not the solution – but that is exactly what SOPA would do.

I rarely agree with Hillary Clinton, but I do agree with her when she said: “When ideas are blocked, information deleted, conversations stifled and people constrained in their choices, the Internet is diminished for all of us.. There isn’t an economic Internet and a social Internet and a political Internet. There’s just the Internet.”

Today Wikipedia, and numerous other sites, are offline to protest this proposed legislation. I stand in full support of Wiki in this matter. Oppose SOPA! If such laws are allowed to pass in America, then we deserve the noose because we have given the government the rope and the authority to tie the knot.

North Hudson Goon

North Hudson is fast becoming the goon capitol of Wisconsin where twenty-something thugs wearing a badge harass citizens on a daily basis. The favorite stakeout for these Barney Fife impersonators is the private property parking lot for the Line-X Truck Liner business.

The thugs apparently start very early in the morning in their pursuit of seat-belt violations, complete stops at stop signs, and the person driving a few miles over the speed limit. If this is the best use of a cop’s time, then I would say that North Hudson has too many thugs on the payroll.

When Barney Fife is sitting in his car during the wee hours of a dark morning, he needs to remember the following scene from American Graffiti before hitting the gas to chase down a driver not wearing their seatbelt.

Get The Hell Off Your Property

As the over-hyped Category 1 Hurricane Irene targeted the east coast of the United States, the customary mandatory evacuations were issued by several governors and even the mayor of New York City. Mayor Bloomberg warned that staying behind was against the law. He later echoed concern for the safety of first responders coming to the aid of those that elected to stay in their homes.

The real question is under what principle of freedom does government have the power to order people off their private property when the same government declares a weather or any other circumstance to be dangerous. Furthermore, when an evacuation occurs who is in charge of protecting my property from thieves taking advantage of the situation? The same police that Mayor Bloomberg says should not be put in harm’s way by people that stay on their property.

If the government can order you off your property for a storm, then the idea of freedom in this country is just blowing in the wind.

Shutting Down A Theft Ring

In neighboring Minnesota a budget showdown looms as the Democratic Governor and the Republican controlled legislature cannot come to terms on how to close a fiscal deficit. If the Governor does not surrender his stance on increasing taxes or the legislature capitulates on spending cuts, then the real possibility exists of the state government shutting down. Of course like all phony government shut downs, essential services will continue.

On the national front, the Republican controlled house is threatening to vote against raising the debt limit if Obama and the Democrats in the Senate do not agree to $2 trillion in spending cuts over the next ten years (not even close enough). Failure to raise the debt limit may result in another shut down in addition to a US Treasury borrowing calamity.

According to a local teacher going by the pseudonym of “One Guy”, government is necessary to keep order in our lives. The only purpose of government in a free society as espoused by true libertarians is to protect the individual and their private property from the force and fraud of others. But as we shall see most of the societal order as “One Guy” proposes to be the role of government is in reality taking the wealth of one individual and giving to another by bureaucratic force.

In part II we will take a look at how effective government programs have been in curing a problem that often has been caused by bureaucratic meddling in the first place.

How much of federal spending is transferring dollars from the pocket of one to another?

The following breaks down the percentage of the federal budget that translates into transfer payments:

Safety Net Programs- 14%
Medicare, Medicaid, and CHIP- 21%

Benefits for federal retirees and veterans- 7%
Interest on debt- 6%
International Foreign Aid- 1%

Nearly 69% of federal spending involves transferring wealth.

Sunday Night Snippet: A House Divided

A sign outside a Hudson establishment has the Lincolnesque words “Divided We Fall”. I speculate this pertains to the cacophony over the passage of the Wisconsin Budget Repair Bill. Since the time this bill was introduced and ultimately passed, government employees including members of the local teachers’ union have engaged in walkouts, violation of private property, extortion on local businesses, and death threats.

In reaction to these thug tactics, government employees and their supporters are now publicly shunned. Individuals now literally spit in the face of their neighbor that teaches at the local government school. Families where some members produce in the private sector and the others that non-work, work in government find themselves bitterly split.

The present situation returns us to a time when neighbor fought neighbor and brother went to war against brother. The sign “Divided We Fall” implies that we all have something in common and our differences must be worked before actual blood spills in the streets. But the two sides of the debate have little in common except residing in the same town or state or nation. Our divide has always been present since the founding of our country.

A compromise between a robber and a victim still results in theft. A compromise between tyranny and liberty still results in tyranny. A compromise between poison and water still results in poison. Read More→

It’s about time…

Please note at approximately 6:05 where Congressman Ryan brings up a point I have made regarding the immoral and outrageous behavior of Republicans of the past. George W. Kumbayah stated more than once that lower tax rates are good because in the end they return more revenue to the federal government. Ryan states a different paradigm, closely resembling what I have advocated. “Yes, we want pro-growth tax reform for job creation, for economic growth, not for tax increasing.” Mr. Ryan has walked up to the door, stepped through and it remains to be see if he gets through the doorway..

What he should have said was that lower taxes are a moral imperative if this country is to remain a free nation; economically premised on the private property and free enterprise.. That the singular purpose of lowered taxation is to reduce the amounts taken by force from the wealth creators and producers in this society. Period, end of discussion. From this premise, all else follows including cutting the budget, reducing the size of the military drastically (it is obscene), and implementing a phase out of social security, medicaid, business tax deductions for health premiums, and on and on.. AND defunding Obama Care.

On balance, this is a very good step towards fiscal sanity.

Chicken Union Thugs

Yesterday, the doorbell rang awakening me out of an afternoon slumber. It was a damn good thing I wasn’t sitting on the pot. A rather straggling looking man and woman stood at the door. In his hand he held a petition to recall State Senator Shelia Harsdorf. Playing along for a moment, I asked to see their driver’s licenses. After refusing to show me any identification, I told them they had to the count of five to get off my property or my anti-socialist dog would be released from his cage.

By the time I got to three they were running like two bums after a beer truck. I decided for good measure to give them the what for as they walked around the block. From what I could tell, the two bums representing union thugs did not get one signature but a whole lot of grief. As many of us have seen over the last few weeks, the thugs have hired others to walk the streets of downtown Hudson to gather signatures.

I started to wonder where all the brave teacher union thugs had gone. Why didn’t Michael Yell or John Dornfeld come knocking at my door asking for a signature. Why don’t you see Roy Sjoberg or Scott Ellingson walking the streets of Hudson for their noble cause? These people are real brave when they are in a crowd of 300 other thugs. Michael Yell showed real bravery when he and few hundred of his goon friends charged over a snow bank on to private property to surround and bang on a car. Hey Michael, why didn’t you show up at my door?!

You know why, because like other bullies you are chicken-shits to face a person one on one that may swing back. You are afraid to hear what people really think of you. If your wish was to pick a fight, then let’s rumble.

You can’t hide behind Dan Tjornehoj’s skirt forever.

Hey Roy, what is with the red flags lining your front yard? You don’t need to advertise that your a socialist, we knew that a long time ago.

Is God a Socialist?

As you prepare for church on Sunday morning, what type of message will the pulpit deliver? Does your minister believe the word of God to be an endorser of liberty or government where Man enslaves another for personal benefit and rights have no definition? Sure we can take certain phrases from certain books of the Bible to make a particular argument. But themes are not cast in single words or a paragraph.

If God created man to be slaves of others, then why lead the Hebrews out of Egypt. Furthermore, if government is an agent of God as some socialist ministers believe, then why would God blaze the Laws to govern human exchange? I argue that the Ten Commandments provided a guide for man to live without the force of government and its natural evolution toward tyranny.

Paraphrasing, thou shall not murder, steal, commit fraud, or envy the possessions of another very much imply the right to life and private property from the force of others. These Laws are the tenets of liberty and voluntary exchange. I do not find the word “unless” in these Laws. Thou shall not through the use of force steal unless a majority of people vote to take it.

The Law affirms our right to our property. Yes, the leftist pulpit will argue that God compels us to be charitable and benefit our fellow Man. But charity depends first on some accumulation or resources that only morally can be attained through free exchange. Is a robber compassionate when his donations came by way of theft? Shakedown

Police function as our agents in the protection of private property from the force and fraud of others, which includes the coercion through threats. As we have witnessed over the last several weeks, our public servants believe the rule of law including the ones pertaining to private property do not apply to them.

Copying almost verbatim the extortion email of the Baldwin-Woodville education thugs, an email signed by police, firefighters, and teachers associations threaten repercussions against businesses that do not actively support their cause against the taxpayers of the state. No doubt the police are engaged in an old fashion shakedown.

The police show themselves no nobler than a thug or gangster. For years we have questioned who the police really protect. Their approach to the average citizen has been that of a bully. This email and events at the Capital and at the Hudson House last week should lay to rest what side of the fence the police will stand.

Kicking the Can Against a Building

Not too many years ago citizens of New Richmond elected school board members interested in protecting taxpayer’s interest. They took positions at odds with the teachers and administration. They also brought transparency to the process that used to be discussed behind closed doors.

The reaction of the union thugs then is much like the attempted bullying we witness today. Back at the time in New Richmond, teachers and supporters disrupted board meetings. School Board members were also targets of attacks against their private property that included slashed tires and malicious damage to homes.

All the while, the local newspaper kept silent about the thuggish behavior. The paper even put out a bounty against one of the Ontheborderline writers who shed light on the situation within the school district. It was all out war against those who dared to stand up to the teachers union.
